Mediation is not only a voluntary and confidential process it is also one of the non court dispute resolution processes that the court will expect the parties to engage in first, should they be thinking of getting the court involved (unless an exemption applies).
Otherwise the party refusing to engage in a non court dispute resolution process like mediation is at risk of paying the other party’s costs should a court application be made first.
The first step is called a MIAM ( Mediation Information and Assessment Meeting ) and is conducted online video.
The MIAM is an opportunity for the Mediator to share important information with each party, including details about the mediation process.
At a MIAM, you will be able to outline what the issues are that you feel need to be resolved. The Mediator will then assess whether the matter is suitable for Mediation.
If the Mediator assesses that the matter is suitable for mediation then the first joint mediation appointment will usually be arranged as soon as possible after the MIAM.
If the case is assessed as not suitable for mediation, the Mediator, if required, will arrange for completion of the necessary form to record this and the parties will be recommended to consult their lawyers as to the alternative ways forward. This may well involve an application to the court.
We charge £125.00 per person for a MIAM session which lasts up to 60 minutes.
